Please read these Terms and Conditions carefully before using this website (www.fom-uk.com). By accessing or using our site, you agree to these terms.

1. About Us

FOM-UK provides outsourced finance and accounting services to UK-based businesses, including online consultations and professional accountancy support.

2. Use of This Website

By using this site, you agree to:

  • Use it only for lawful purposes.

  • Not misuse the site to spread malware, unsolicited communications, or harmful content.

  • Not interfere with or disrupt website functionality.

3. Online Bookings & Payments

We offer online consultations via this website. Any service engagement is subject to our Engagement Letter, which includes the terms of service, fees, and cancellation policies. You must review and agree to the engagement letter before proceeding with any paid services.

Payments are processed securely via Stripe; we do not store full card details.

4. Intellectual Property

All materials on this site (text, graphics, branding, layout, etc.) are owned or licensed by FOM Accounting Ltd and are protected under intellectual property law. No part may be reused or copied without written permission.

5. Data Collection

We may collect data through web forms, including personal and business details required for service enquiries or onboarding. For more details, see our Privacy Policy and Cookies Policy.

6. Disclaimer

The information on this site is for general guidance only and does not constitute professional advice.

We do not accept any liability for losses arising from reliance on content found on the site.

All services are provided based on formal engagement and subject to our engagement terms.

FOM Accounting Ltd does not accept responsibility for decisions made by HMRC, Companies House, or other authorities, even if our services support related filings or advice.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under English law.

8. Limitation of Liability

To the extent permitted by law, FOM Accounting Ltd shall not be liable for:

  • Any indirect, consequential or special loss, including loss of profits, revenue, data or business opportunity.

  • Losses resulting from unauthorized access to or alteration of your data.

  • Delays or failures caused by factors beyond our control.

9. Governing Law

These Terms are governed by and construed under the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We may update these terms from time to time. Continued use of the website after any changes implies your acceptance of the revised terms. Material changes will be highlighted on this page or notified via email where practicable.

11. Identity Verification and ACSP Services

11.1 Overview

FOM Accounting Ltd, trading as FOM-UK, is an Authorised Corporate Service Provider (ACSP) registered with Companies House. We provide two services related to Companies House identity verification.

11.2 “Who Needs to Verify” Review Service

A limited review of your company records held at Companies House to identify which directors and/or persons with significant control (PSCs) must complete identity verification and the applicable deadlines. This service is based solely on the information held at Companies House at the time of the check. We are not responsible for any errors, omissions, or outdated information in the Companies House register, and our report should not be relied on if the underlying data is inaccurate. This service does not constitute legal or compliance advice.

11.3 ACSP Identity Verification Service (“Get Verified With Companies House”)

Completion of identity verification for company directors and/or PSCs in accordance with Companies House requirements. The process involves initial ID checks carried out through our verification partner, TrustID, followed by submission of the required verification details to Companies House.

11.4 Turnaround Times

“Who Needs to Verify” reports are normally delivered within five working days.

ACSP identity verification services are provided on two service levels:

  • Premium Service – Verification completed and submitted to Companies House within oneworking day of successful ID check.

  • Standard Service – Verification completed and submitted to Companies House within fiveworking days of successful ID check.

11.5 Scope Of Checks (ACSP Identify Verification Service Only)

This service covers basic ID checks only.

If an ID fails the basic checks but can be reasonably verified through additional or enhanced checks, a supplementary fee may apply. Clients will be notified before any further checks are carried out.

If an ID fails the basic checks and is deemed high risk (for example due to industry, country, or PEP status), we reserve the right to decline or discontinue the verification service. In such cases, a 50% refund will be issued.

11.6 Fees

All fees for both services are payable in advance and are strictly non-refundable once the service has commenced.

Where supplementary fees are required, these will be communicated before proceeding.

If you choose not to proceed with supplementary checks, we will be unable to complete the verification, and no refund will be provided.

If we decline or discontinue a verification due to high risk, a 50% refund will be issued.

11.7 Limitations Of Liability

FOM-UK will use reasonable care and skill in providing these services but is not responsible for delays, errors, or failures caused by Companies House, TrustID, or any other third-party provider, nor for circumstances beyond our reasonable control.

We do not guarantee that Companies House will accept or approve any verification, even if the ID check is passed through TrustID.

11.8 Data Handling

By requesting either service, you consent to FOM-UK collecting and processing the personal data necessary to complete the checks, including identity documents, in accordance with our Privacy Policy.

FOM-UK is regulated by the ACCA and subject to anti-money laundering (AML) requirements. We may retain identity verification records, including reports and related documents, for a minimum of seven years as required by law.

12. Switch Bonus Terms

12.1 Eligibility

The Switch Bonus is available to new clients who switch their accounting and/or finance services to FOM-UK and are accepted as a client following our normal onboarding, identification, anti-money laundering and client acceptance checks.

12.2 How the Switch Bonus is calculated

The Switch Bonus is calculated as three times the client’s initial approved first year compliance fee. The first year compliance fee is based on the initial agreed monthly compliance package fee multiplied by 12. Any later changes to the client’s monthly fee will not change the value of the Switch Bonus unless agreed by FOM-UK in writing.

12.3 Estimates

Any Switch Bonus or fee shown through our website, calculator, marketing materials or other communications is an estimate only unless confirmed by FOM-UK in writing. The final fee and Switch Bonus will be confirmed after we review the client’s circumstances and required services.

12.4 Using the Switch Bonus

The Switch Bonus may be used from the first eligible invoice issued after the Switch Bonus has been confirmed in writing. The Switch Bonus may be used to reduce eligible fees charged by FOM-UK by one-third. The remaining two-thirds must be paid by the client. All fees and Switch Bonus calculations are calculated before VAT.

12.5 Eligible fees

The Switch Bonus may be used against the following FOM-UK services:

  • Compliance packages

  • Fractional Finance Advisor services

  • Fractional Finance Department services

  • Personal tax returns for directors of the client company

The Switch Bonus may also be used against other FOM-UK services where we approve this in writing.

12.6 No cash value

The Switch Bonus has no cash value and cannot be exchanged for cash, refunded, transferred, sold or assigned to another person or business.

12.7 Leaving FOM-UK

The client must remain an active FOM-UK client to use the Switch Bonus. If the engagement with FOM-UK ends for any reason, any unused Switch Bonus will be cancelled and no payment or refund will be due in respect of the unused balance.

12.8 Availability of the offer

The Switch Bonus is subject to availability. FOM-UK may change, suspend or withdraw the Switch Bonus offer at any time for anyone who has not yet had their Switch Bonus confirmed in writing, including where we have reached our capacity for new clients.

12.9 Existing Switch Bonuses

Any change, suspension or withdrawal of the Switch Bonus offer will not affect a Switch Bonus already confirmed in writing for a client, unless otherwise permitted under these terms or agreed with the client.

12.10 Incorrect information or misuse

FOM-UK may refuse, reduce or cancel a Switch Bonus where information provided by a prospective or existing client is inaccurate, misleading or incomplete, or where FOM-UK reasonably believes the offer has been misused.

12.11 Relationship with engagement terms

The Switch Bonus forms part of the client’s commercial arrangement with FOM-UK and should be read alongside the client’s engagement letter and these Terms and Conditions. If there is any conflict, the engagement letter will take priority.
